Tingkatkan Posisi Tawar Negara Asia-Afrika Bidang Kekayaan Intelektual

BANDUNG, (PR).-
Sidang Forum Asia Afrika (FAA) yang diikuti 50 negara, Senin (18/6) hingga Rabu (20/6) di Hotel Hyatt Jln. Sumatera Kota Bandung, melahirkan ”Deklarasi Bandung” tentang Upaya Perlindungan Sumber Daya Genetika, Pengetahuan Tradisional, dan Ekspresi Folklore (SDGPTEF).

”Deklarasi Bandung” berisi 11 butir kesepakatan untuk meningkatkan posisi tawar negara-negara di kawasan Asia-Afrika, dalam upaya memberi perlindungan terhadap SDGPTEF di ajang internasional yang lebih tinggi.

”Mudah-mudahan deklarasi ini bisa ditarik ke sidang Inter-Governmental Committee (ICG) Genetic Resources, Traditional Knowledge dan Folklore (GRTKF) World of Intelectual Property Organization (WIPO) yang ke-11 Juli 2007 di Jenewa,” kata Perwakilan Tetap Indonesia untuk PBB di Jenewa, Dr. Makarim Wibisono, Rabu (20/6).

Sidang WIPO yang ke-11 digelar untuk membentuk international legally binding (regulasi internasional yang mengikat-red.) guna melindungi negara-negara pemilik SDGPTEF. ”Indonesia merupakan negara dengan sumber daya genetika terbesar di dunia,” kata Makarim.

Namun, hingga sidang ke-10, ujar Makarim, negara-negara maju seperti Amerika dan Jepang selalu menunda-nunda terbentuknya regulasi tersebut.

”Mereka sangat keberatan terutama dengan perlindungan terhadap sumber daya genetik. Coba bayangkan, jika sudah terbentuk regulasi itu, maka mereka yang menggunakan sumber daya genetika kita harus membayar. Kita akan sangat kaya, karena pada dasarnya banyak sumber daya genetika yang dipakai negara maju,” katanya.

Negara-negara yang mengikuti sidang FAA di Kota Bandung, merupakan negara-negara yang kaya sumber daya genetika, pengetahuan tradisional, dan ekspresi folklore.

”Memang, sulit untuk memaksa negara-negara maju di bidang perekonomian dan militer untuk membayar ke negara-negara berkembang. Namun, kita akan terus memperjuangkan hal tersebut,” ujar Makarim.

Harus bersatu

Sementara itu, Deputi Dirjen WIPO Dr. Francis Gurry mengatakan, sulit untuk menentukan kapan regulasi itu bisa benar-benar terwujud. Namun, Gurry meyakinkan agar negara-negara berkembang yang kaya GRTKF atau SDGPTEF harus bersatu dan menentukan sikap bersama, guna meningkatkan posisi tawar terhadap negara-negara maju.

”Ini adalah salah satu proses menuju terbentuknya international legally binding untuk GRTKF. Orang-orang juga tidak pernah menyangka, kalau langkah ini akan sampai pada kesepakatan atau deklarasi internasional bahwa hak-hak kekayaan intelektual itu sangat penting,” katanya.

Direktur Hak Cipta dari Dirjen Hak Kekayaan Intelektual (HaKI) Depkum dan HAM RI Anshori Sinuangan mengatakan, HaKI adalah fundamental perekomian bangsa. Negara yang kaya dengan GRTKF tapi miskin HaKI maka akan jadi tempat eksploitasi.

”Sebaliknya, negara yang kecil tapi kaya dengan HaKI, maka dia akan lebih makmur. Oleh karena itu, butuh penyadaran bagi masyarakat kita. Sebab, di balik karya seseorang ada penghargaan dan nilai ekonomi yang tinggi,” ujarnya.

Deklarasi Bandung FAA 2007 menekankan pada pengertian hak negara terhadap GRTKF, sebagai aset nasional yang memiliki nilai sosial, budaya, dan ekonomi untuk mempercepat proses pembentukan instrumen hukum yang mengikat bagi perlindungannya.

”Negara-negara Asia-Afrika akan memperkuat koordinasi serta kerja sama dalam melestarikan, melindungi, dan mempromosikan SDGPTEF,” kata Makarim.
